Green & Green, Lawyers Shareholder Jared Wagner successfully defends Gordon Food Service in the Ohio Supreme Court. That Court sustained the 12th District's decision affirming the trial court's grant of summary judgment in favor of Gordon Food Service, and other defendants.
This case involved the question of whether a customer should reasonably expect an allegedly injurious substance that is natural to the product being served, in this case a chicken bone in a chicken dish, even thought that product was labeled as being a "boneless" wing.
This is an important decision, not just for GFS in this specific instance, but for all producers, supplies, and sellers of meat products in Ohio. It also means that the wing restaurants throughout Ohio don't have to change their menus from boneless wings to something like mini-chicken fillets! The case even made NPR!

Two lawyers from Green & Green, Erin B. Moore, and Fred Young answered a call from the Ohio State Bar Association to serve The Foodbank in Dayton at the volunteer day on January 27, 2024. Our lawyers joined members of the local bar, the Young Lawyers Section and Ohio State Bar Foundation Fellows in collective efforts to reduce hunger by assisting the Foodbank in food donation organization for stocking its Marketplace and emergency food boxes. The Foodbank then provided a tour of its incredible facilities.

Congratulations to our President Erin Moore for obtaining a defense verdict in an admitted liability auto accident case tried to a jury in the Warren County Court of Common Pleas. Plaintiff claimed a resulting rotator cuff injury, but Erin successfully showed the jury the claimed injury was preexisting and unrelated to the accident. The jury found no proximate cause for the injuries claimed and returned a verdict for her client.
The result came not only from the facts of the case and Erin’s skills in the courtroom, but from the hard work and extensive time she put in to prepare for trial to pursue the client’s goals. Erin, this is a well-deserved victory!
Green & Green, Lawyers shareholder Erin Moore will be participating as part of a panel discussion at this year’s Bench Bar conference presented by the Dayton Bar Association. The theme is "By Failing to Prepare, You are Preparing to Fail", in the esteemed words of Benjamin Franklin. This panel of experienced trial lawyers will discuss lessons learned in preparing and trying cases. Topics include preparation and handling of lay witnesses, preparation of experts and clear communication of expert testimony to juries, cross examination, and some key features of opening statements and closing arguments and their connection with jury instructions.

On June 26, 2023, Green & Green, Lawyers, hosted a blood drive at its offices through the American Red Cross. The drive was done as a memorial to Michael Gallagher, paralegal Trina Gallagher’s husband, who recently passed away. The blood drive was very successful. The drive brought an amazing 16 first time donors.

Our firm congratulates shareholder Fred Young for his election as Vice President of the Dayton Bar Foundation. Fred has served on the Board of that organization since 2022, and previously held the position of Treasurer. Fred’s service to our legal community also include service on the Board of Trustees of the Dayton Bar Association. He also served as President of that group for the 2020-2021 term.
The Dayton Bar Foundation is a charitable organization which serves as the philanthropic arm of the Dayton Bar Association. The Foundation was formed exclusively for charitable and educational purposes with the object of using its resources to foster the integrity of the legal profession, to facilitate the administration of justice, to defray the administrative expenses of providing pro bono legal services to indigent persons, and to aid lawyers in need.
Green & Green, Lawyers Shareholder Erin Moore was sworn in as one of the newest Members-at-Large of the Board of Trustees of the Dayton Bar Association. She will serve a two year term. Erin was appointed by incoming President Anne P. Keeton.

Erin Moore, a shareholder of Green & Green, Lawyers, prevailed for her client, the appellant, Owners Insurance Company, in EMOI Services, LLC v. Owners Insurance Company, Slip Opinion No. 2022-Ohio-4649, decided by the Ohio Supreme Court on December 27, 2022.
In EMOI Services, LLC v. Owners Insurance Company, the unanimous Court agreed that the business property insurance policy at issue, which by its terms required “direct physical loss of or damage to” property, did not provide coverage for losses claimed due to a ransomware attack on appellee’s computer systems where there was no “direct physical loss of or damage to” the hardware or media on which the software was stored. In reaching this conclusion, the Court found that under the policy terms, “covered media” means media that had a physical existence and that software itself, independent of that media, as information or a set of instructions, does not have a physical existence.
The Court expressly held that the language in the electronic equipment endorsement in the policy was “clear and unambiguous” in its requirement that there be physical loss or physical damage and that since software is an inherently an intangible item that cannot experience direct physical loss or direct physical damage, there was no applicable coverage.
